Terms & Conditions
These Terms & Conditions (“Terms”) govern services provided by 68Development LLC (“we”, “us”, or “our”) to clients (“you” or “client”). By submitting a payment or deposit, you agree to be bound by these Terms.
1. Scope of Services
68Development LLC provides website design, development, hosting, app builds, and related creative services. Each project is defined by an agreed scope, deliverables, and pricing outlined in your proposal or invoice. Additional requests outside of the agreed scope may incur additional fees.
2. Deposits & Payments
- A minimum deposit of 50% of the one-time project cost is required to begin work unless otherwise stated in writing.
- The remaining balance is due upon completion of the project, prior to final delivery, launch, or transfer of ownership.
- If “Pay in Full” is selected during checkout, no remaining balance will be due after project completion.
- All deposits are non-refundable once work has begun, as time, design, and development resources are immediately allocated.
3. Hosting & Monthly Services
68Development LLC offers both Free Hosting and Paid Hosting options, along with other monthly service plans such as maintenance and content updates.
- Free Hosting: Provided at no monthly charge and intended for light traffic or testing purposes. Sites on Free Hosting may enter “sleep mode” after 15 minutes of inactivity (similar to Render’s free plan). When asleep, sites may take several seconds to wake upon first visit. Free Hosting is not guaranteed for continuous uptime or performance.
- Paid Hosting ($20/month): Includes continuous uptime, faster load speeds, and priority maintenance. Recommended for production websites and active businesses requiring reliable 24/7 availability.
- Other Monthly Services: Maintenance, updates, and app-related services are billed automatically each month from the date of activation.
- Billing & Cancellation: Monthly services renew automatically unless canceled with at least 30 days’ written notice via email to support@68development.com. Cancellations made mid-cycle are not eligible for prorated refunds.
Clients may upgrade or downgrade hosting or maintenance plans at any time by request. 68Development LLC is not responsible for outages or downtime that occur as a result of third-party hosting providers or free-tier service limitations.
4. Client Responsibilities
- You agree to provide all necessary content, images, login credentials, and approvals in a timely manner.
- Delays in providing required materials or feedback may extend the estimated delivery time.
- Any stock imagery, plugins, or third-party tools requested by the client may incur additional costs.
5. Ownership & Intellectual Property
All design, code, and assets remain the sole property of 68Development LLC until final payment has been received in full. Upon full payment, ownership of the completed website or application (excluding proprietary frameworks or third-party libraries) is transferred to the client.
68Development LLC reserves the right to display completed projects in our portfolio, social media, and marketing materials for promotional purposes unless otherwise agreed upon in writing.
6. Revisions & Support
Each project includes a specified number of revisions as outlined in your proposal or plan. Additional revisions, feature requests, or changes made after project completion may be billed separately at the current hourly or package rate.
7. Refunds & Cancellations
- Deposits are non-refundable once work has begun.
- If the client cancels a project before work begins, a 10% processing fee will be deducted from any refunded deposit.
- Monthly service fees are non-refundable for partial months or unused time.
8. Timelines & Delivery
Estimated completion times are based on current workloads and client response times. We are not responsible for delays caused by unresponsive communication, late content submission, or third-party service interruptions (hosting, domain providers, etc.).
9. Liability
While every effort is made to ensure high-quality, secure, and functional websites, 68Development LLC shall not be held liable for any damages, loss of revenue, data breaches, or technical failures arising from website use, downtime, or third-party integrations.
In no event shall our total liability exceed the amount paid for the project or service in question.
10. Confidentiality
All information shared between client and 68Development LLC will be treated as confidential and will not be disclosed to third parties except as required to complete the project or by law.
11. Termination of Services
We reserve the right to pause or terminate services in the event of non-payment, abusive behavior, or violations of these Terms. Any unpaid balances will remain due immediately upon termination.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Mississippi, United States. Any disputes will be handled in a court of competent jurisdiction located in Harrison County, Mississippi.
13. Updates to These Terms
We may update these Terms periodically. Any changes will be reflected on this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the new Terms.
